Dear
Friends,
Convicted
child molesters will get longer prison sentences beginning
Oct. 1, when remaining laws passed in the January 2010 General
Assembly take effect. Also among the new laws are measures
aimed at keeping bicyclists, boaters and automobile drivers
safer. Oct. 1 is the usual date for new laws to take effect.
However, the budget and many other bills already are in
effect.
- Jessica's Law
Enhancement. This long-overdue law triples
the current sentence and requires a 15-year
mandatory minimum sentence for second-degree child
rape.
- Clamp-down on Child
Pornography. Tightens child porn laws,
especially as they relate to depiction of children on the
Internet.
- Impaired Boat Operators Subject
to Breath or Blood Tests. Because boaters
now have the right to refuse breath or blood tests,
prosecution is difficult. SB475 requires them to submit to
the tests if detained by a police officer.
- Cars to Give Bicycles
More Room. SB51 requires automobile
drivers to safely overtake a bicycle, electronic personal
assistive mobility device, or a motor scooter at a distance
of at least three feet. SB624, a related bill,
requires vehicles to yield the right-of-way to bicycles in a
crosswalk under certain circumstances.
- No TV While
Driving. A motor vehicle driven on a
Maryland highway may be equipped with video display
equipment only if it is turned off when the screen is
visible to the driver. This restriction does not apply to
vehicle navigation systems.
- "Castle Doctrine" Lets
Us Defend Our Homes. We've all heard stories about
burglars who are shot by homeowners, then sue the homeowner
for their injuries. SB411 provides that we are not liable
for civil damages for personal injury or death of someone
who enters our home or business under certain
circumstances.
